1. Acceptance of the general terms and conditions of sale

1.1 The contract entered into between Leader Watch Company Srl and the Customer shall be considered concluded with the acceptance, even partial, of the order by Leader Watch Company Srl. Such acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided for, the Customer declares to have read all the information provided to him/her during the purchase procedure, and to accept in full the general terms and conditions and payment terms set out below.

1.2 If the Customer is a consumer (i.e. a natural person who buys goods for purposes not related to his/her professional activity), once the online purchase procedure is completed, he/she will print or save an electronic copy and in any case keep these general terms and conditions of sale, in compliance with the provisions laid down in the Consumer Code (Legislative Decree 206/05) on distance sales.

1.3 Any right of the Customer to damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order.

2. How to purchase

2.1 The Customer may only purchase the products present in Leader Watch Company Srl's electronic catalogue under the LORENZ brand at the time of placing the order and which can be seen online at www.lorenz.it as described in the relevant product information sheets. It is understood that the image accompanying the description of a product is as accurate as possible but cannot ensure a perfect similarity and may differ in colour, size and accessories shown.

2.2 The correct receipt and acceptance of the order is confirmed by Leader Watch Company Srl by means of an e-mail reply, sent to the e-mail address provided by the Customer during the purchase or registration.

2.3 In case of non-acceptance of the order, Leader Watch Company Srl guarantees timely communication to the Customer.

4. Methods and costs of delivery

4.1 Leader Watch Company Srl ships exclusively by express courier and sends all over the world

4.2. Shipping costs are charged to Leader Watch Company Srl

4.3 Leader Watch Company Srl shall not be liable for any delay of order fulfilment or in the delivery of the order.

4.4 Upon delivery of the goods by the courier, the Customer is obliged to check:

a) that the number of packages delivered corresponds to the number indicated in the transport document;

b) that the packaging is intact, undamaged, neither wet nor otherwise altered, including in the sealing materials (adhesive tape or metal strapping).

4.5 Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications, must be immediately challenged by placing the written indication SUBJECT TO VERIFICATION (SPECIFYING THE REASON, e.g. "punctured packaging", "crushed packaging", etc.) on the courier's proof of delivery document. Once the courier's document has been signed, the Customer will not be able to object to any dispute regarding the external characteristics of the delivered goods.

4.6 Any problems relating to the physical integrity, completeness or correspondence of the products received with what is indicated in the order confirmation e-mail (in particular the presence of the instructions and the warranty coupon), must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

4.7 In case of failure to collect within 5 working days the material in storage at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of order, the order will be returned to the warehouses of Leader Watch Company Srl, which will retain the amount corresponding to the cost of storage of goods at the warehouses of the Courier as well as the cost of transporting the goods to its own warehouses.

4.8 If the purchaser fails to collect the goods within 3 months, Leader Watch Company Srl will consider the goods as uncollected and will retain an amount equal to the cost of the goods as a penalty.

5. Right of withdrawal

5.1 Pursuant to Legislative Decree 206/05, if the customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Leader Watch Company Srl a VAT number reference), he/she has the right to withdraw from the purchase contract for any reason, without explanation and without penalty, except as indicated in paragraphs 5.3 and 5.5 below.

5.2 To exercise this right, the customer must send Leader Watch Company Srl a communication to this effect, within 14 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to Leader Watch Company Srl via Pietro Mascagni, 15 20122 Milan, or by telegram or fax sent within the aforementioned period of 14 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent STRICTLY within the following 48 hours. Once the above-mentioned notice of withdrawal has been received, Leader Watch Company Srl will quickly provide the customer with instructions on how to return the product. The goods must be returned intact, complete with all their parts and in their original packaging (envelopes and packaging), stored and, if necessary, used with normal diligence, without any signs of wear or dirt, in compliance with the conditions of points 5.3 and 5.5 below.

5.3 The right of withdrawal is in any case subject to the following conditions:

a) the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased;

b) the goods purchased must be intact and returned in their original packaging, complete in all their parts;

c) in accordance with the law, the shipping costs related to the return of the goods are at the expense of the customer; any other incidental expenses reported at the time of placing the order will not be refunded;

d) the shipment, until the certificate of receipt is signed in our warehouse, is under the full responsibility of the customer;

e) in case of damage to the goods during transport, Leader Watch Company Srl will inform the customer of the incident (within 5 working days from receipt of the goods in its warehouses), enabling him/her to file a timely complaint with the courier and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, at the same time cancelling the request for withdrawal;

f) Leader Watch Company Srl is not liable in any way for damage or theft/loss of goods returned by uninsured shipments; h) upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and/or the original packaging are damaged, Leader Watch Company Srl will deduct from the refund due a percentage, in any case not exceeding 10% of the same, as a contribution to the costs of restoration

5.4 Without prejudice to any repair costs for damage to the original packaging, Leader Watch Company Srl will refund the customer the full amount already paid, within 14 days of return of the goods, by reversal of the amount charged to the credit card or by bank transfer to current account or PayPal. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code of the person in whose name the invoice was issued).

5.5 The right of withdrawal is totally forfeited, for lack of the essential condition of integrity of the goods (packaging and/or its content), in cases where Leader Watch Company Srl ascertains:

a) the non-diligent use of the good which has compromised its integrity, or the use of any consumables;

b) the absence of the original outer packaging and/or inner packaging;

c) the absence of product elements (accessories, manuals, components, ...);

d) damage to the product for reasons other than transport. In case of forfeiture of the right of withdrawal, the goods will remain at the headquarters of Leader Watch Company Srl at the Customer's disposal for collection at his/her expense.

6. Warranties

6.1 All products sold by Leader Watch Company Srl are covered by the conventional warranty of the manufacturer and the 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02. In order to benefit from warranty assistance, the Customer must keep the warranty coupon present in the original packaging, as well as the invoice issued by Leader Watch Company Srl. The exercise of the Warranty may include the request for assistance to the Authorized Service Centres of the area and/or the procedures detailed in the documentation inside the product packaging.

6.2 The conventional manufacturer's warranty is provided in the manner detailed in the documentation inside the product packaging. If, following the intervention by an Authorized Service Centre, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and repair required by the Authorized Service, as well as transport costs, if incurred by Leader Watch Company Srl

6.3 The warranty of 24 months in accordance with Legislative Decree 24/02 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and with the instructions specified int the attached technical documentation. This warranty is reserved for the private consumer (a natural person who buys goods for purposes not related to his/her professional activity, or makes the purchase without indicating a VAT number on the order form). In case of lack of conformity, Leader Watch Company Srl provides, without charge to the Customer, to restore the conformity of the product by repair/replacement or reduction of the price, until the termination of the contract. If, as a result of intervention by an Authorized Service Centre, the defect does not result in a lack of conformity in accordance with Legislative Decree 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transportation costs if incurred by Leader Watch Company Srl

6.4 Replacements in case of DOA (Dead On Arrival: product not working on delivery) will be made following checks by Leader Watch Company Srl.

6.5 If, for any reason, Leader Watch Company Srl is unable to return a product under warranty (restored or replaced) to its customer, Leader Watch Company Srl may proceed at its own discretion to refund the amount paid taking into account the use of the product or to replace it with a product of equal or superior characteristics.

6.6 In cases where the application of the warranties provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc. ...); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided.

7. Privacy

7.1 The personal data requested when placing the order is collected and processed in order to meet the express requests of the Customer and will not under any circumstances and for any reason be transferred to third parties. Leader Watch Company Srl guarantees its customers compliance with the regulations on the processing of personal data, governed by the privacy code according to Article 13 of EU Regulation no. 2016/679

7.2 The data controller is Leader Watch Company Srl, with registered office in Milan, via Pietro Mascagni, 15.

8. Complaints

Any complaint must be addressed to Leader Watch Company Srl by registered letter with acknowledgment of receipt to the following address: Leader Watch Company Srl via Pietro Mascagni 15 – 20122 Milano.

9. Governing law

The sales contract between the Customer and Leader Watch Company Srl is signed in Italy and governed by Italian law.
